ORDER

When the matter is taken up for hearing today, the learned counsel appearing for the respondents 1 and 2 submitted a letter dated 15.11.2023 of the 3rd respondent, Pondicherry Textile Corporation Limited (A Government of Puducherry Undertaking), Mudaliarpet, Puducherry, wherein it is stated that the amount recovered earlier years from the employees of the AFT Mill amounting to Rs.2,35,53,580/- had been remitted to the AFT Employees Co-operative Credit Society Ltd., in two installments i.e. Rs.50,00,000/- in March 2021 and Rs.1,85,53,580/- in May 2021 and as such there are no dues as on date to be settled to the Credit Society by the AFT Mill. It is further stated in the abovesaid letter that the petitioner should implead the members of the Credit Society,

who have not paid the loan dues and proceed against them by following due process of law.

2. There is no representation on behalf of the Writ Petitioner. A perusal of the records shows that on many occasions there were no representation on behalf of the Writ Petitioner.

3. In view of the above, the Writ Petition is dismissed for non prosecution. No costs. Consequently connected Writ Miscellaneous Petition is closed.
