(Order of the Court was made by S.S.SUNDAR, J.) The above miscellaneous petition has been taken out by the petitioner herein, who is the wife of the Convict Prisoner-Sathiq Basha (Convict No.3315), to extend the ordinary leave granted to the petitioner's husband / life convict for a period of 20 days.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. The only request of the petitioner is that the presence of the convict prisoner is required on account of the fact that the mother of the convict prisoner has to be admitted for an emergency surgery. In this regard, the petitioner has also enclosed the medical report from the hospital. But this Court is unable to see the medical condition of the mother of the convict prisoner from the said document. However, the Probation Officer shall verify the authenticity and the medical condition of the mother of the convict prisoner and report before this Court on the next adjourned date when the matter is posted for reporting compliance, if it is otherwise. Therefore,

considering the reasons stated in the affidavit filed in support of the miscellaneous petition, this Court is inclined to extend the ordinary leave for a period of 15 days. Accordingly, the ordinary leave granted to the Convict Prisoner viz., Sathiq Basha, S/o Saleem Basha (Convict No.3315) vide the order of this Court dated 17.10.2023 in W.P.No.22285 of 2023 for a period of 30 days i.e., from 20.10.2023 to 18.11.2023, without escort, is hereby extended for a further period of 15 days, on the following conditions: (i) The Convict Prisoner shall return back to the Central Prison, Puzhal, Chennai on 03.12.2023 at 05.00 p.m.

(ii) The Convict Prisoner is directed to report before the D-3, Ice House Police Station, Chennai, daily at 10.30 a.m. The writ miscellaneous petition is ordered accordingly. Post the matter for reporting compliance on 05.12.2023. (S.S.S.R.,J.) (S.M.,J.) 17.11.2023 ss
