J U D G M E N T

(Judgment of the Court was delivered by R.SUBRAMANIAN, J.) The prayer in the Writ Petition is for a Mandamus to direct the respondents 3 and 4 to furnish the statement of accounts of the loan account of the petitioner.

2. A Banker-Customer relationship is purely a matter for contract. 2/5

If there is any dispute between the two, in respect of the said contract it is for the aggrieved party to approach the Competent Civil Court to have the dispute resolved. Article 226 of the Constitution of India cannot be made a machinery to resolve such disputes. It is settled law that the constitutional Court under Article 226 of the Constitution of India will not interfere in contractual issues.

3. Hence, we do not see any reason to interfere with the order of the Writ Court, the Writ Appeal fails and it is accordingly dismissed. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
