A complaint was registered in Crime No.466 of 2023 on 07.10.2023 for the offence under sections 170, 451, 392, 506(1) & 34 of IPC is under investigation by the respondent police. The defacto complainant has filed this application seeking for alteration of sections by including sections 120(b), 362& 363 of IPC alleging that police has not registered the case under the relevant provisions of IPC.

2. The learned Government Advocate (Crl. Side) submitted that, based on the complainant, case has been registered and it is under investigation. During the course of the investigation, if any material is collected, then the sections will be appropriately altered and reported to the Judicial Magistrate.

3. Recording the same, this Criminal Original Petition is disposed of on the ground that, investigation is at nascent stage and therefore there is no necessity for any specific direction to add certain sections or IPC at the midst of the investigation.
