M. Pushpanathan v. P. Uma Maheswari
C.M.P.No.23798 of 2025 in CMA. SR. No.113934 of 2025 C.V.KARTHIKEYAN, J.
AND K.RAJASEKAR, J.
This petition has been filed seeking to condone the delay of 10 days in preferring the appeal against the judgment dated 22.04.2025 in O.P.No.438 of 2023.
2.The said original petition had been filed seeking guardianship / custody of two minor children. It is contended that the custody of the elder son had been granted to the petitioner and the custody of the younger son had been granted to the respondent.
3.Notice had been directed in this petition and the same had been served. The name of the respondent is also printed in the cause list. Full opportunity would be granted to the respondent to argue the appeal. 4.Taking all the factors into consideration, the delay is condoned. Accordingly, this petition stands allowed. The Registry may number the appeal, if it is otherwise in order and list the same in the usual course. (C.V.K., J.) (K.R.S., J.) 05.03.2026 smv https://www.mhc.tn.gov.in/judis
