The Contempt Petition has been filed to punish the respondent for willful disobedience of the order of this Court in Crl.O.P.No.20729 of 1/4

2020 dated 06.01.2021.

2.When the matter was taken up for hearing, affidavit of the respondent has been filed and the relevant portions are extracted hereunder:

"7.I respectfully submit that, in compliance with the order dated 06.01.2021 passed in Crl.O.P.No.20729 of 2020, the then Inspector of Police examined the witnesses and recorded their statements and took his sincere and effective steps to identify the accused. After completion of elaborate and detailed investigation, the then Inspector of Police closed the case in Cr.No.1657 of 2015 as "Undetected" and served the R.C.S Notice vide R.C.S No.19 of 2021 to the complainant by Registered post on 08.09.2021.

8.I respectfully submit that as per the proceedings of the District Munsif Cum Judicial Magistrate Court, Madhavaram vide D.No.103/2022, dated 07.09.2022 closed the case in Cr.No.1657 of 2015 for the reason that the FIR is barred by limitation and hence this FIR is closed as time barred u/s.468(2) Cr.P.C."

3.A copy of the proceedings of the District Munsif Cum Judicial Magistrate, Madhavaram, dated 07.09.2022 was also placed before this Court. It is seen that the FIR itself was closed as time barred and that apart, the investigation has also been completed and was closed as 2/4

undetected.

4.In the light of the above development, no further orders can be passed in this Contempt Petition.
