The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 170, 395, 397, 457 IPC @ 120(b), 170, 364(A), 395, 397, 450, 457 and 465 IPC, in Crime No.41 of 2022 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner along with the other accused, by entering into the house of the de-facto complainant under the guise of CBI Officers, attacked him and taken away several lakhs of amount and other valuable things. Hence the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and he was no way connected with the alleged offence. He further submitted that even though the name of the petitioner does not find place in the First Information Report, he was falsely implicated in this case. He also submitted that the petitioner is ready to abide by any stringent

conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner along with the other accused claiming them to be the CBI Officers entered into the de-facto complainant's house and taken away a sum of Rs.7,60,000/- and other the valuable things. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the entire materials available on record.

6. Taking into consideration the facts and circumstances of the case and the submissions made by the learned counsel and also considering the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed. 23.12.2022 ham
