ORDER
The present writ petition has been filed to issue a writ of mandamus directing the first and second respondents to consider the representation of the petitioner dated 05.08.2024 and 22.09.2024 respectively.
2. It is the case of the petitioner that while he was working in Dubai from 1989 to 2010, the petitioner sent all his earnings to his wife who bought two properties were purchased in the name of petitioner's wife as the petitioner could not come to India. Thereafter, the petitioner came back to India, but his wife did not allow him to enter the house and started ill treating him. After that, he took up a job as a security guard in a bank and is now aged about 66 years. When he returned back to home, his house lacked with the tolet board. Hence the petitioner has given a Page No.2 of 6
representation dated 105.08.2024 to the first respondent seeking direction to his wife and children to give him shelter in the lower portion of his house situated at Chengalpattu and the rent from the two shops abetting his house to enable the petitioner to sustain his life as he worked although his life and the properties were registered in his wife's name who is admittedly unemployed and a house wife and is only a name lender. Now, the petitioner is working with a bank as a security guard and staying before the ATM on the street. On such receipt of the said representation, the respondents did not take any action till date. Hence, the petitioner has filed the present writ petition.
3. The learned counsel appearing for the petitioner submitted that the representation of the petitioner dated 05.08.2024 to the first respondent as well as the second respondent and no orders have been passed till date.
4. The leaned Government Advocate appearing for the respondents 1 and 2 submitted that the representation of the petitioner dated 05.08.2024 has been considered by the second respondent and the orders Page No.3 of 6
have been passed vide Proceedings in Mu.Mu.No.A1/1985/2024 dated 04.12.2024 . The said order can be challenged by way of appeal before the first respondent, Appellate Authority, District Collector .
5. Heard the learned counsel appearing on either side and also perused the materials available on records.
6. In view of the submissions made by the learned counsel on either side, it is open for the petitioner to prefer the appeal before the Appellate Authority as per rules.
7. This writ petition is disposed of with the above observation. No costs.
