This Original Petition has been filed taking advantage of Section 372 of the Indian Succession Act, 1925 seeking Succession Certificate with respect to the debt in the name of Mr.B.A.Chidambaranathan, who died intestate on 31.08.2007. The 1st petitioner is his daughter-in-law / wife of the predeceased son of the deceased and the 2nd and 3rd petitioners are the sons of the 1st petitioner. The 4th to 8th petitioners are the other sons and daughter of the deceased. The wife, Thulasi, of the deceased, Mr.B.A.Chidambaranathan had died subsequently on 25.08.2013 and the son, C.Rajamani / husband of the 1st petitioner and father of the 2nd and 3rd petitioners had died on 14.02.2016. 2.After following due procedure, the petitioners were directed to tender evidence. Accordingly, the 7th petitioner, C.Murali, examined himself as PW-1.

The death certificate and legal heirship certificate of his father, Mr.B.A.Chidambaranathan were marked as Exs.P1 and P2. The death certificate and legal heirship certificate of his mother, Mrs.Thulasi, were marked as Exs.P3 and P4. The death certificate and legal heirship certificate of his brother, C.Rajamani were marked as Exs.P5 and P6. The letter relating to the debts, which had been mentioned in the schedule to the petition was marked as Ex.P7.

smv 3.Taking into consideration the nature of evidence adduced and the documents produced, this Original Petition stands allowed. The Succession Certificate may be issued in favour of the 1st, 4th to 8th petitioners in accordance with the rules.
