This miscellaneous petition has been filed to condone the delay of 103 days in filing the application to set aside the abatement caused due to the death of the 3rd respondent.

2. Heard the learned counsel for the petitioner and the learned counsel appearing for the 1st respondent.

3. On being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay is condoned. Accordingly, the petition stands allowed.
