ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. This case is registered for the alleged offence u/s.420 of IPC, 1860. This occurrence is of the year 1998. Originally the case was filed against two accused in CC.No.32 of 1999. The mother case went into trial and is also over and the records itself is stated to be not available. Whether the mother case ended in conviction or acquittal is also not known. Even the the Police also do not have any record. As far as the other accused is concerned, the case is pending for execution of the warrant. The case was split up in the year 2018 and is now pending as CC.No.35 of 2008. Absolutely, the existence of the accused is not traceable. Even if the warrant is executed and the accused is brought to books, no useful purpose will be served in keeping the matter pending.

3. Accordingly, the case in C.C.No.200035 of 2008 on the file of District Munsif cum Judicial Magistrate No.I, Hosur Taluk, Krishnagiri, stands quashed. This Suo Motu Transfer Case is disposed of. 19.09.2025 rap electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
