Respondents Prayer: Writ Petition under Article 226 of the Constitution of India

praying for a writ of Mandamus directing the respondents 1 to 4 to conduct enquiry and take necessary action against the respondents 5 and 6 for illegal mining and stealing government properties on the basis of the petitioner's representation dated 28.11.2022 in accordance with law within the time stipulated by this Court. ORDER

(Made by the Hon'ble Acting Chief Justice) The petitioner has filed this writ petition seeking a direction to the respondents 1 to 4 to conduct an enquiry and to take necessary action against the respondents 5 and 6 as they were illegally mining and stealing government properties, based on his representation dated 28.11.2022.

2. Prima facie, we are unable to entertain this writ petition for the sole reason that the representation is said to have been given by

the petitioner only on 28.11.2022. Admittedly, the official respondents should be given some breathing time to consider the said representation and to take necessary action. Without giving such time, the petitioner cannot complain inaction on the part of the official respondents.

3. In view of the above, the writ petition fails and hence, the same is dismissed. There will be no order as to costs. (T.R., ACJ.) (D.B.C., J.) 22.12.2022 kpl To
