This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 10.10.2024, seeking bail in Crime No.420 of 2024 for the alleged offences punishable under Sections 126(2), 296(B), 115(2), 311, 351(3) of BNS.

2. The case of the prosecution is that the accused had waylaid the de facto complainant and his employee, abused them in filthy language and by intimidating them at a knife point, robbed a sum of Rs.1350/- from them.. Hence the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner has been suffering incarceration from 10.10.2024, hence, he prayed for grant of bail to the petitioner stating that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court.

Learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing for grant of bail to the petitioner, submitted that the petitioner/accused had robbed a sum of Rs.1350/- from the de facto complainant, when he was returning from his shop along with his employee. He further submitted that the petitioner is a habitual offender, against whom, 10 previous cases of similar nature are pending.

5. Heard both sides and perused the materials available on record .

6. Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) and also considering the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the Criminal Original Petition stands dismissed for the present.
