Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to dispose of the petitioner's representation dated 04.09.2024 and consequently direct the respondents to correct the error and insert the name of the petitioner's Son Sandeep Kumar A in the place of A.P.Sandeep Kumar, the name of the petitioner as C.Ashok Kumar in the place of Ashok, the name of petitioner's wife as Bhavani A in the Place of Priya and issue a fresh corrected birth certificate to the petitioner, within the time period that may be fixed by the Honble Court.

ORDER

The writ petition has been filed in the nature of mandamus seeking a direction to the 2nd respondent, the Zonal Officer, Zone-9, Division-122, Greater Chennai Corporation, Nungambakkam to correct the name of the son of the petitioner as "Sandeep Kumar A." instead of "A.P.Sandeep Kumar" and the name of the petitioner as "C.Ashok Kumar" instead of 2/6

"Ashok" and the name of the wife of the petitioner as "Bhavani A." in the place of "Priya" in the birth certificate of the petitioner.

2. In effect, the petitioner wants to correct the name of his son, of himself and of his wife. The son's name was given as "A.P.Sandeep Kumar" and the petitioner wants it to be corrected as "Sandeep Kumar A." This is understandable, since the name of the petitioner is Ashok Kumar. The petitioner also wants to correct his name from "Ashok" to "C.Ashok Kumar". This is also understandable, since the name "Ashok" could have been given, as the petitioner would always been called only as "Ashok" and only rarely as "Ashok Kumar".

3. The petitioner also wants to correct the name of his wife from "Priya" to "Bhavani A." There is no connection between the names "Priya" and "Bhavani". So far as this is concerned, the respondents may examine the hospital records, wherein the son of the petitioner was born and examine the name of the mother of the son of the petitioner in the hospital register. It is also to be noted that, the wife of the petitioner has not filed any separate 3/6

affidavit stating that her name was wrongly given as "Priya" and that the correct name is Bhavani.

The 2nd respondent may, therefore, also require rules and regulations, issue notice to the petitioner, make an enquiry and thereafter, if the rules permit, make the corrections, otherwise pass a detailed order as to why the corrections cannot be made. The entire exercise shall be completed on or before 29.11.2024.

5.With the above observations, this Writ Petition stands disposed of. No costs.
