Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, forbearing the respondents from acting upon the eviction notices dated 28.04.2022 issued by the fifth respondent and evicting the petitioners from the land under their respective domicile, comprised in S.Nos.299/4 and 5 of V.Marudur Village, Villupuram until the first respondent passes order/s on the application dated 13.08.2022 made by the petitioners through their Association by name, "Villupuram K.K.Road Annai Indira Nagar Residents Welfare Association" seeking alienation to them for fair price the respective lands under their domicile. ORDER
(Made by the Hon'ble Chief Justice) Heard Mr.S.Rajendiran, learned counsel for the petitioners and Mr.P.Muthukumar, learned State Government Pleader for the respondents.
2. Learned counsel for the petitioners submits that an application has been filed by the petitioners on 13.08.2022, seeking alienation of lands to them for fair price. The said application is not yet decided. It is further submitted that eviction notice was issued on 28.04.2022.
3. It is submitted by learned State Government Pleader that the District Administration has taken efforts to identify alternate lands in the nearby village and has identified S.Nos.75 and 386/2 at Thirupachanur Village. The number of beneficiaries are 221. House site pattas will be issued to the eligible beneficiaries as per the existing Rules.
4. The Division Bench of this Court in W.P.No.33556 of 2017 has already passed an order to evict the encroachments in V.Marudur Lake in Villupuram. The deadline has been issued in that regard. In view of that, the parties may take steps in accordance with law.
5. In the light of that, the writ petition stands disposed of. There will be no order as to costs. Consequently, W.M.P.Nos.32354 and 32355 of 2023 are closed.
