ORDER

The grievance of the petitioner in this Writ Petition is that eventhough on the crucial date, there was no existing punishment, the petitioner has not been considered for inclusion of his name in the promotion panel for the post of Assistant Executive Engineer for the panel year 2017-2018 or in the panel year 2019-2020.

2. The petitioner has given a representation on 08.11.2022 to the respondents, requesting them to include his name in the panel of promotion for the post of Assistant Executive Engineer for the panel year 2017-2018 or in the panel year 2019-2020. Since the representation has not been considered till date, he has filed this Writ Petition.

3. Heard, Mr.D.Ashok Kumar, learned counsel for the petitioner and Mr.Krishna Ravindran, learned Standing Counsel accepts notice on behalf of the respondents.

4. No prejudice would be caused to the respondents if the petitioner's representation as stated supra is considered on merits and in accordance 2/5

with law within a time frame to be fixed by this Court.

5. For the foregoing reasons, this Court directs the first respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 08.11.2022 seeking for inclusion of his name in the panel of promotion list for the panel year 2017-2018 or in the panel year 2019-2020 for the post of Assistant Executive Engineer, within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the aforementioned directions, this Writ Petition is disposed of. No Costs.
