The petitioner/A2 who was arrested and remanded to judicial custody on 01.02.2023 for the offences registered under Section 174 Cr.P.C and subsequently, altered to Section 306 of IPC r/w Section 3(2)(v) of SC & ST (POA) Act, 2015, in Cr.No.800 of 2023 on the file of the respondent Police, seeks bail.
2.It is stated that the deceased had committed suicide on 24.10.2023 and a complaint has been lodged by the mother of the deceased on 25.10.2023. It must also been stated that the deceased belongs to a Schedule Caste community.
3.It is the contention of the learned counsel for the petitioner that the petitioner had been taken into custody on 28.10.2023 and that he has been in custody for the past 87 days. It is stated that the petitioner had no relationship at all with the deceased and had been wrongly included as an accused by the respondent.
4.The Suicide note of the deceased had been recovered and it is the case of the prosecution that originally the deceased had a relationship with 1/3

Vkr deceased had natured a one sided relationship with the petitioner herein, but the petitioner belongs to Devanga Chettiyar community and had specifically refused the deceased only on the ground that she belongs to Schedule Caste community.
5. The offence is directly attracted, I am not inclined to grant bail to the petitioner.
