4 R.S.SIVAPRAKASAM 5 S.SANTHI PRASAD Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to order paper publication for the respondents 2 and 4 in local Tamil newspaper Makkal Kural and thus render justice.(in CMP.No.26656/2019) Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.N.BALAJI, for M/S.MCGAN LAW FIRM, Advocate for the petitioner and of M/S.A.SHANMUGARAJ, Advocate for the 2nd respondent and of M/S.J.CHANDRAN, Advocate on behalf of the 3rd respondent the court made the following order:- The third respondent in the Civil Miscellaneous Appeal has filed this application for effecting publication to the second and fourth respondents, for whom notice could not be served through Court and by post, which has been returned as door locked.

2. Though the second and fourth respondents have been set exparte in the proceedings before the lower Court, on petition filed for condone delay, this Court on 1.11.2019 had condoned the delay and Ordered notice to the respondents and directed the petitioner to take private notice to the respondents. As the notice sent to the second and fourth respondents has not been served, this application has been filed for ordering substitute of service in 'Makkal Kural' to the second and fourth respondents.

3. Hence, the applicant is directed to effect paper publication in one of the "Makkal Kural" newspaper fixing the hearing date on 08.01.2020.

4.This application is Ordered accordingly.
