The petitioner seeks anticipatory bail in Crime No.740 of 2023, registered by the respondent police for the offence under Section 328 of IPC and Section 24(1) of COTPA Act.

2.The petitioner herein is the owner of the godown at Katcheri Mettu Street, where, about 490 kgs of banned tobacco products had been seized. The learned counsel for the petitioner states that A1 to A4 had been taken into custody and had been granted bail. But the petitioner is only an owner of the godown.

3.It is also the case of the respondent that there are four previous cases of similar nature pending against the petitioner herein. 4.The earlier anticipatory bail application of the petitioner in Crl.O.P.No.25460 of 2023 had been dismissed on 07.11.2023. 5.Since there is no change in circumstance in this case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
