Respondents Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, calling for the records of the third respondent in connection with the impugned order in O.M.No.3188/Aa/2000 dated 28.07.2000 insofar as he has effused to approve the appointment of the petitioner in the post of Physical Education Teacher in the fourth respondent school and quash the same and consequently direct him approve the appointment of the petitioner in the said post with effect from 17.06.1998.

ORDER

Challenging the order of the third respondent dated 28.07.2000 and for a consequential direction to the fourth respondent to approve the appointment of the petitioner in the said post with effect from 17.06.1998, the present writ petition has been filed.

When the matter is taken up for hearing, the learned Additional Government Pleader would submit that a letter was sent by the fourth respondent's school dated 03.08.2017, wherein it is stated that the petitioner was joined in service on 17.06.1998 under the fourth respondent's school. Subsequently, the petitioner had left the school on 03.03.2005 and thereafter, his whereabouts were not known to the school.

3. Though this case was heard on several hearings, there was no representation for the petitioner. On 03.08.2017, the third respondent/ District Educational Officer, Tirunelveli Town, Tirunelveli, was directed to appear before this Court on 07.08.2017 and he has appeared on that day. Even today also there is no representation for the petitioner and therefore, this Court is of the view that the petitioner is not interested to prosecute the case. Accordingly, the writ petition is dismissed. No costs.
