Defendants PRAYER: Plaint filed under Order VII Rule 1 of the CPC., 1908 r/w. Order IV Rule 1 of the High Court Original Side Rules praying for the judgment and decree against the defendants as follows: (i)Declare that the notice dated 07.12.2022 issued by the 1/4

second defendant calling for Annual General Meeting (AGM) of the first defendant Society to be held on 30.12.2022 as illegal, null and void; (ii)Permanent injunction, restraining the second defendant from calling for an Annual General Meeting (AGM) of the first defendant Society to be held on 30.12.2022;

(iii)Mandatory Injunction directing the first defendant Society to permit the plaintiffs to participate in the Annual General Meeting to be held, if any, of the first defendant Society; (iv)Mandatory Injunction directing the second defendant to furnish a copy of the final report of the forensic review conducted by M/s.Deloitte Touche Tohmatsu India LLP, which forms part of Agenda 7 of the notice dated 07.12.2022; and (iii)To pay the cost of the suit.

J U D G M E N T

The learned counsel for the plaintiffs seek permission of this Court to withdraw the Civil Suit and he has also made an endorsement to that effect.

2. In view of the submission of the learned counsel for the plaintiff and the endorsement so made, this Civil Suit is dismissed as withdrawn. No costs. Registry is directed to return the Court Fee if permitted, as per the rules.
