ORDER
[Order of the Court was made by S.M.SUBRAMANIAM, J.] This criminal miscellaneous petition has been filed seeking to suspend the sentence imposed on the petitioner vide judgement and order dated 17.10.2023 passed in S.C.No.112 of 2021 on the file of the learned Sessions Judge, Fast Track Mahila Court, Krishnagiri and to enlarge the petitioner on bail pending disposal of the appeal. 2.
The petitioner is an accused in SC. No.112 of 2021 on the file of the learned Sessions Judge, Fast Track Mahila Court, Krishnagiri. The respondent Police prosecuted the petitioner for the offence under Section 302 of IPC. After trial, the Trial Court found him guilty and sentenced to undergo imprisonment for life and also imposed a fine of Rs.1,000/- and in default to undergo one year simple imprisonment.

Aggrieved by this, the petitioner filed an appeal. Pending appeal filed this miscellaneous application to suspend the sentence. 4.
Heard the learned Counsel appearing on behalf of the petitioner and the learned Additional Public Prosecutor. 5.
The present petition seeking suspension of sentence is considered with reference to the prima facie case. We have gone through the evidence of P.W.1 the daughter of the deceased and P.W.2 the Son-in-Law of the deceased. Both the eyewitnesses speak cogently and narrated the seen of occurrence.

Therefore, we are not convinced with the grounds raised by the petitioner seeking suspension of sentence. The other grounds are to be adjudicated during final hearing of the main criminal appeal.

Since the petitioner has not made out any prima facie case for suspending the sentence, the present Miscellaneous Petition stands dismissed.
