Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, Direct the 3rd respondent to issue patta to the petitioners in the land allotted by the Government of Tamil Nadu in the survey No 14/11 Uranithangal village Gingee Taluk, Villupuram District 604 202.

O R D E R

Despite being aware of the fact that orders of injunction had been passed by the Principal District Munsif, Gingee in I.A.73/15 in OS.No.11/2015 is in force, the petitioner had sent a representation to the 3rd respondent to issue patta and the Writ Petition is filed for a direction to consider and pass orders on the said representation.

2. Heard the learned counsel on either side.

The District Munsif, Gingee had passed an order of injunction restraining the 1st and the 3rd respondents herein and others from interfering in any manner with the petitioner's peaceful possession and enjoyment of the property. While the injunction order is in force, the respondents cannot be directed to issue patta as the same would amount to interfering with the petitioner's possession. Therefore, the Writ Petition is dismissed.

4. However, Mr. S.T.Varadharajalu, the learned counsel for the petitioner would submit that the suit has been filed as early as in the year 2015 and therefore directions may be issued for its speedy disposal. Considering this request, while dismissing the Writ Petition, the District Munsif, Gingee is directed to dispose of the suit O.S.No.11/2025 within a period of 6 months from the date of receipt of a copy of this order.
