The learned counsel for the petitioner has mentioned this matter today on the ground that he was not given an opportunity of hearing when the matter was listed yesterday i.e. on 06.11.2024 and this Court has passed a final order in W.P.No.26608 of 2024 without hearing him. Hence, this application is taken up for hearing today.

2. This impleading application was not heard by this Court yesterday i.e. on 06.11.2024 as it was filed only yesterday.

3. Here is the case where both the parties appeared and the matter was taken up on emergency hearing only on the ground that the examinations are to be held and the same is postponed by the TNPSC based on the suggestions made by this Court in the earlier occasions i.e. on 25.10.2024 and 30.10.2024. The Learned Standing Counsel appeared for TNPSC has sought only an order, postponing the examinations of Draughtsman and Field Surveyor, since the other party felt that it is based on the Diploma subjects which has to be reduced to the syllabus which will

be based on the ITI syllabus. Further, In order to accommodate the ITI students, the Learned Standing Counsel for TNPSC has come up with a decision that, they will conduct the examinations of the above said two posts, only based on the ITI syllabus. Hence, this Court has passed a final order in W.P.No.26608 of 2024 by observing as follows: "9. In view of the submission made by the Learned Standing Counsel, this Court is of the view that, the examination of Paper-I for the posts of Draughtsman (Serial No.26) and Field Surveyor (Serial No.27) may be conducted on 09.11.2024 and 14.11.2024 as scheduled by the Commission. Insofar as examination of Paper-II for the posts of Draughtsman and Field Surveyor are concerned, the Commission may consult and issue a fresh notification by specifying common syllabus for both Diploma and I.T.

I holders and sufficient time to be given to the candidates to appear for the exam. The examination for the post of Surveyor-cum-AssistantDraughtsman has been withdrawn by the Commission. Hence, it is for the Commission to issue a notification (addendum) for common exam for the post of Surveyorcum-Assistant-Draughtsman for both Diploma and I.T.I holders."

4. Under the above circumstances, this Court is not inclined to entertain this application and accordingly, it is dismissed. However, it is made clear that, if the petitioner is having ITI syllabus, he can very well appear for the above said exams and compete with the others. 07.11.2024 raja Note: Issue order copy on 08.11.2024 V.BHAVANI SUBBAROYAN, J.
