Writ Petition filed under Article 226 of the Constitution of India, praying to call for the records relating to the order of the Central Administrative Tribunal, Chennai Bench dated 25.08.2023 made in O.A.No.670 of 2023, confirming the order of the third respondent dated 31.03.2023 made in Order No.SCR/P.500/SFP/K.Seenivasan, quash the same and consequently direct the respondents herein to grant secondary Family Pension to the petitioner herein with effect from 16.01.2020 on which date, the deceased ex-employee/pensioner died and also other monetary benefits payable to the petitioner herein.

ORDER

(Order of the Court was made by K.Kumaresh Babu J.) The present writ petition has been filed, seeking a Writ of Certiorarified Mandamus, to quash the order of the Central Administrative Tribunal, Chennai Bench, dated 25.08.2023 made in O.A.No.670 of 2023, confirming the order of the third respondent dated 31.03.2023 made in Order No.SCR/P.500/SFP/K.Seenivasan and to direct the respondents herein to grant secondary Family Pension to the petitioner herein with effect from 16.01.2020 on which date, the deceased ex-employee/pensioner died and also other monetary benefits payable to the petitioner herein. 2/5

2. The learned counsel for the petitioner submitted that liberty had been given to the petitioner to get a Succession Certificate to seek Disability Pension.

3. The learned counsel for the petitioner sought permission of this Court to withdraw the writ petition and to approach the appropriate forum, seeking appropriate relief. The learned counsel for the petitioner has also made an endorsement to that effect.

4. Recording the said submission, the writ petition stands dismissed as withdrawn with liberty to the writ petitioner to seek appropriate relief in the manner known to law. If the petitioner approaches the appropriate forum, the period of his claim from the date of filing the original application before the Central Administrative Tribunal till today shall stand excluded, while computing the period of limitation, if any. No costs.
