This Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 24.10.2024, seeking bail in Crime No.390 of 2024 registered for the offences under Sections 318 & 105 of BNS.
2. The case of the prosecution is that, the petitioner is a quack Doctor who had administered the injection, resulting in the death of the defacto complainant's son. Hence, the case.
3. Learned counsel appearing for the petitioner would submit that petitioner is an innocent person and he has been falsely implicated in this case. He would submit that the petitioner is a qualified registered pharmacist. He would further submit that defacto complainant only asked medicine for his son, other then that, the petitioner has not committed any offence as alleged by the prosecution. Hence, he prays the grant of bail to the petitioner.
4. Learned Government Advocate (Crl.Side) appearing for the respondent police while opposing for the grant of bail to the petitioner, would 1/3
submit that, the petitioner is a quack practicing Doctor without any qualification. He would submit that the petitioner had administered an injection, which he is not authorised to do, injected to the defacto complainant's son, which resulted in death. He would further submit that, petitioner has 7 previous cases, out of which, in 3 cases he has been acquitted and in 4 cases, investigation is still pending.
5. Heard the learned counsel appearing for the petitioner, the learned Government Advocate (Crl.Side) appearing for the respondent Police and perused the materials available on record.
6. Taking into consideration the above facts and circumstances of the case, the submissions made by the learned counsel on either side and the bad antecedents against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
Accordingly, this Criminal Original Petition is dismissed. 15.11.2024 dsn 2/3
