Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the respondent to appoint a surveyor/engineer for physical measurement of the property and award compensation for 16 sq.ft., to the petitioner as per the present market value of the property, based on the petitioner's representation dated 21.09.2016 within a time frame as may be fixed by this Court.

ORDER

The Writ Petition has been filed to direct the respondent to appoint a surveyor/engineer for physical measurement of the property and award compensation for 16 sq.ft., to the petitioner as per the present market value of the property, based on the petitioner's representation dated 21.09.2016 within a time frame.

Heard Mr.E.Senthilkumar, learned counsel appearing for the petitioner, and Mr.Jayesh B.Dolia, learned counsel appearing for the respondent.

Without expressing any opinion on the merits of the Writ Petition, the respondent is directed to issue notice to the petitioner, within a period of two weeks from the date of https://hcservices.ecourts.gov.in/hcservices/

the receipt of a copy of this Order and to consider the representation of the petitioner dated 21.09.2016, to appoint a Surveyor/ Engineer for physical measurement of the property and pay compensation, after giving opportunity of hearing and pass orders on merits and in accordance with law, within a period of twelve weeks thereafter.
