ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offence publishable under Sections 4(1)(A) and 4(1-A)(ii) of TNP Act, in Crime No.396 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found to be illegally transporting 900 bottles of Pondicherry made country breeze arrack using a TATA Ace Mini Van bearing registration No.TN 73 V 5037, without any valid permission. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate-Criminal Side would submit that the petitioner was found in illegal transportation of 900 bottles of Pondicherry

made country breeze arrack. He would further submit that there are one previous case against the petitioner. Hence, he would vehemently oppose for the grant of anticipatory bail to the petitioner.

5. Taking into consideration the nature of offence and the fact that there are one previous cases against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
