The petitioner is A2 in Spl.S.C.No.42 of 2020, now pending before the Sessions Judge for Special Court for POCSO Cases at Chengalpattu, seeks bail. Originally, Crime No.57 of 2019 had been registered for the offences punishable under Sections 450 of IPC & 3(a) r/w 4, 5(1) r/w 6, 21(1) & 17 of POCSO Act, 2012. The petitioner had been taken into custody on 22.02.2022 but only after Non-bailable Warrant had been executed. The said NBW had been issued on 30.09.2021.

2.The 1st accused, had also been granted bail and he is appearing before the Court. It is stated that two victim children have been examined in chief.

3.Let their cross-examination by both the accused be completed and thereafter, issuance of bail can be certainly considered by this Court. At this stage, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed with liberty to file fresh application.
