This Original Petition has been filed under Sections 222 and 276 of the Indian Succession Act, 1925 along with the relevant rules of the Original Side of Madras High Court seeking probate of the last Will of V. Ramachandran, late husband of the petitioner and the father of the respondents, who died on 30.04.2023 at New South Wales in Australia. The respondents have not raised any objection for grant of probate to the petitioner.
2.After following due procedure, the petitioner was directed to tender evidence and accordingly, she examined herself as PW-1. The death certificate of her husband was marked as Ex.P1. The original Will dated 24.02.2023 was marked as Ex.P2. The petitioner also examined, Mr.G.Mohan, as PW-2, who was one of the attesting witness and he affirmed and identified Ex.P2 Will and stated that, he and other attesting witness Mr.K.Arunachalam attested the Will in the presence of the executor, who also signed the Will in their presence. He stated that the executor was in a sound and disposing state of mind at the time of execution of Ex.P2 Will. His affidavit was marked as Ex.P4.

smv 3.In view of the evidence adduced, this Original Petition stands allowed. The probate may be issued in favour of the petitioner in accordance with the rules.
