Crl.O.P.No.27912 of 2024 A.D.JAGADISH CHANDIRA, J.

This Criminal Original Petition has been filed by the petitioners, who were arrested and remanded to judicial custody on 14.10.2024, seeking bail in Crime No.268 of 2024 for the alleged offences punishable under Sections 126(2), 296(b), 115(2), 311, 351(3) of BNS, 2023.

2. The case of the prosecution is that the accused has waylaid the de facto complainant, abused him in a filthy language, assaulted him with hands and robbed a sum of Rs.2,100/- from him at knife point and escaped from the scene of occurrence. Hence the case.

3.Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case since they have several previous cases. He also submitted that the petitioners are in custody from 14.10.2024 and they are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioners.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioners has waylaid the de facto complainant and by assaulting him and intimidating him at knife point,

robbed a sum of Rs.2,100/- from him. He also submitted that five previous cases are pending against the petitioners, hence, he opposed for grant of bail to the petitioners.

5. Heard both sides and perused the materials available on record.

6. Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) and also considering the previous cases pending against the petitioners, this Court is not inclined to grant bail to the petitioners.

7. Accordingly, the Criminal Original Petition stands dismissed for the present.
