PRAYER Writ petition filed under Article 226 of Constitution of India for issuance of a Writ of Mandamus directing the respondents 1 to 4 to consider the representation of the petitioner dated 02.07.2025 in accordance with law and direct the 3rd and 4th respondents to De-seal the petitioner Medical shop at No. 3/61 H.Echampadi Harur Taluk, Dharmapuri District to secure the ends of Justice.

ORDER

By consent of the either parties, the writ petition is disposed at the admission stage itself.

2. This petition has been filed seeking to issue a direction to the respondents 1 to 4 to consider the representation of the petitioner dated 02.07.2025 in accordance with law and to direct the 3rd and 4th respondents to De-seal the petitioner's Medical shop at No. 3/61 H.Echampadi Harur Taluk, Dharmapuri District to secure the ends of Justice. 2/5

It is the case of the petitioner that the petitioner is the owner of the shop and the shop was rented to one R.Chandasekaran, who was running alopathy medicine without proper licence from the medical department, hence on 28.06.2023, the respondents 3 and 4 and several police officials vacated the said Chandrasekaran, who was unauthorisedly selling the alopathy medicine without license and sealed the door. Since the said shop is locked for more than 2 years and the petitioner, being owner of the shop, submitted representation to the respondents to deseal the medical shop, however, no action was taken till date and hence, the present writ petition.

The learned counsel for the petitioner submitted that this Court may issue a direction to the fourth respondent to consider the representation of the petitioner and pass appropriate orders within the time stipulated by this Court. 5.Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the fourth respondent to consider and pass orders on the petitioner's representation dated 02.07.2025 within a period of four weeks from the date of receipt of a copy of this order.
