2. When the matter came up for hearing on 23.09.2021, the matter was adjourned to 08.10.2021 for filing counter finally. When the matter was taken up for consideration on 08.10.2021, this court has observed that though final chance was given to the respondent for filing counter, there was no counter filed by the respondent and again at the request of the respondent, it adjourned the matter to 28.10.2021 for filing counter finally, failing which, orders will be passed in the impleading petition.

3. Again when the matter is taken up today for consideration, it appears that no counter has been filed. Hence, being satisfied with the reasons stated in the affidavit filed in support of this petition, this Civil Miscellaneous Petition is allowed as prayed for.
