ORDER
This petition has been filed to enlarge the petitioner on bail in Crime No.14 of 2025 on the file of the Vigilance and Anti-Corruption Police Station, Coimbatore.
2. The petitioner herein, who is the Assistant Commissioner of HR & CE, was caught red-handed while receiving a bribe amount of Rs.1,50,000/- from the defacto complainant for complying the Court's direction. Hence, the FIR has been registered in Crime No.14/2025 on the file of the V & AC Police Station, for the alleged offence u/s.7(a) of the Prevention of Corruption Act Amendment.
3. The learned counsel appearing for the petitioner submitted that the phenolphthalein test conducted on the spot was found negative and the money was not recovered from the petitioner herein, as alleged by the prosecution. Further, he submits that the petitioner has been falsely implicated in this case. Further, he submits that the petitioner is ready to abide any conditions and also willing to deposit any amount to any charitable trust or as directed by the Court.. Hence, he prays to allow this petition.
4. The learned Government Advocate raised objection stating that the petitioner had demanded bribe from the defacto complainant and the same was intercepted by the respondent and recovered the amount from the petitioner. Hence, he prays to dismiss this petition.
5. Considering the period of incarceration undergone by the petitioner and also the fact that the investigation is almost completed. Further the petitioner is aged about 58 years. Hence, this Court is inclined to grant bail to the petitioner with conditions.
6. Accordingly, the petitioner is ordered to be released on bail on executing separate bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only)
with two sureties, in which one surety must be a blood surety for a like sum to the satisfaction of the Judicial Magistrate No.2, Coimbatore, and on further conditions that:
(a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(b) the petitioner shall report before the respondent police on every Tuesday and Saturday at 10.30 a.m. for the period of three months. Further, the petitioner is directed to deposit a sum of Rs.2 lakhs to the credit of Arignar Anna Government Hospital of Indian Medicine, Account No. 110101106507, Canara Bank, Aminjikarai, Chennai - 29. IFSC Code: CNRB0016021(Sidha).
(c) the petitioner shall not tamper with evidence or witness either during investigation or trial;
(d) the petitioner shall not abscond either during investigation or trial;
(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail
by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;
(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
