2. These Civil Miscellaneous Petitions are filed to condone the delay of 270 days in filing the petition to set aside the abatement caused due to the death of the sole appellant in the Second Appeal; to set aside the abatement; and to bring on record the legal heirs of the deceased sole appellant as Respondents 2 to 5 in the Second Appeal, respectively.

3. Along with the petitions, the petitioners have filed Death Certificate, dated 17.11.2022, and Legal Heir Certificate, dated 07.12.2022, in respect of the deceased appellant, issued by the Tahsildar, Sankarapuram Taluk, Kallakurichi District.

4. Heard the learned counsel for the petitioners.

5. Though the name of the counsel for respondents is printed in the Cause List, none appears.

6. Having been satisfied with the reasons stated in the affidavits filed in support of the petitions, I allow these Civil Miscellaneous Petitions.
