Egmore at Allikulam, Chennai whithin a period of four weeks from today. Failing which, the order passed by this Court shall stand automatically cancelled in order dated 14.08.2025 passed in Crl.MP.No.15586/2025 in Crl.RC.No.1439/2025.

ORDER

This Criminal Miscellaneous Petition has been filed to modify the condition imposed by this Court in Crl.M.P.No.15586 of 2025 in Crl.R.C.No.1439 of 2025 dated 14.08.2025 in para 5(i) as follows :- "5.(i) the petitioner shall deposit the entire cheque amount, after deducting the amount which was already deposited by the petitioner, if any, to the credit of C.C.No.1829 of 2020 on the file of learned Metropolitan Magistrate, Fast Track Court No.I, Egmore, at Allikulam, Chennai, within a period of four weeks from today. Failing which, the order passed by this Court shall stand automatically cancelled. "

The learned counsel for the petitioner submitted that he has already deposited 20% of cheque amount and due to his poor economic condition, he finds difficult to comply the condition imposed by this court and he has also challenged liability. Hence, the present petition has been filed to modify the condition.

Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit a sum of Rs.3,00,000/- (Rupees three lakhs only) to the credit of C.C.No.1829 of 2020 on the file of learned Metropolitan Magistrate, Fast Track Court No.I, Egmore, at Allikulam, Chennai, within a period of six weeks from the date of receipt of copy of this order and he shall produce the said receipt before the court below.

4. Except the above modification, the other conditions imposed by this Court in in Crl.M.P.No.15586 of 2025 in Crl.R.C.No.1439 of 2025 dated 14.08.2025 shall remain unalterted.
