ORDER
This petition has been filed to enlarge the petitioner/accused on bail in Crl.No.604 of 2025 on the file of the respondent police for the offence punishable under Sections 103(1) of BNS, 2023.
2. Based on the complaint given by the SaviGounder, in connection with the suspicious death of one Kavinraj, the police investigated the matter based on CCTV footage and the statement of an eye witness, who is a petrol bunk staff. The petitioner was arrested on 29.06.2025. Hence, the case.
3. The learned counsel for the petitioner submits that the petitioner has falsely implicated in this case and no way connected with this case. Hence, he prays to grant bail.

The learned Government Advocate submits that the petitioner was working as supplier in the Tasmac,where there was wordy quarrel between the petitioner and the deceased and attacked each other, due to which the Kavin Raj died. Further, the submits that petitioner is the sole accused and the
investigation is completed.

Considering the fact that the petitioner is sole accused he is under the judicial custody for past three months and also the investigation is almost completed. Hence, this Court is inclined to grant bail to the petitioner with conditions.

Accordingly, the petitioner is ordered to be released on bail on executing separate bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, in which one surety must be a blood surety for a like sum to the satisfaction of the Judicial Magistrate, Sulur, and on further conditions that::
(a) the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(b) the petitioner shall report before the respondent police on every Tuesday and Saturday at 10.30 a.m. Until further orders.
(c) the petitioner shall not tamper with evidence or witness either during investigation or trial;
(d) the petitioner shall not abscond either during investigation or trial;
(e) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;
(f) if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.

On considering the fact that the deceased died leaving behind his family members, it is a fit case to refer, as per 357(A) (1) (2) and (6) of Cr.P.C., the Chairman, District Legal Services Authority, Coimbatore, is hereby directed to pass appropriate orders to the District Collector , Coimbatore, for disbursing the compensation amount of Rs.2,00,000/- as interim compensation to the family members, in the manner known to law based on the available schemes within a period of 6 weeks from the date of receipt of copy of this order. 12-09-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes pbl
