The Criminal Revision is filed against the order in Crl.M.P.No.10007 of 2022 dated 05.08.2022 passed by the 23rd Metropolitan Magistrate,Saidapet, Chennai-15 and direct the first respondent to return the car bearing Registration No.TN 06 K 9669, Mercedes BENZ, based on the agreement dated 18.06.2020 between the petitioner and the said Tamil Selvi/second respondent herein to secure the ends of justice.
2. The learned counsel for the petitioner submitted that based on the complaint lodged by the defacto complainant, the vehicle was seized by the respondent police. To recover the said car, the petitioner filed a petition before the trial Court and the same was dismissed. Further, during pendency of the revision, the matter is amicably settled between the petitioner and the defacto complainant and therefore, this Court may direct the first respondent to release the vehicle.
3. The learned counsel for the defacto complainant submitted that she has no objection for releasing the vehicle to the petitioner. 2/4
4. Heard both sides and perused the materials available on record.
5. Considering the facts and circumstances of the case and recording the submission made by the learned counsel on either side, this Court directs the first respondent to release vehicle to the petitioner in the manner known to law.
