The Petitioners who had been granted anticipatory bail in Crl.O.P.Nos.20619 and 20620 of 2023 by an order dated 12.09.2023 have filed the aforementioned petitions seeking modification with respect to the payment of amount/deposit of amount to the Court and seeking extension of time to execute sureties and to relax the conditions.

While granting anticipatory bail, my learned predecessor had stated that each of the two petitioners shall deposit a sum of Rs.10,00,000/- (Rupees Ten Lakhs Only) to the credit of Crime No.121 of 2023 and it had been further stated that if they produce the receipt, of such deposits, they shall be released on anticipatory bail. It was also directed that they should report before the respondent police everyday at 10.30 a.m., for a period of four weeks.

3. The learned counsel for the petitioners has filed an affidavit of the Accused Chandrasekar Ruthrappa/A2 who had, along with the affidavit 1/4

enclosed a receipts in the form of RTGS payments to the defacto complainant to a total amount of Rs.20,00,000/- (Rupees Twenty Lakhs Only) from the account of both the petitioners. In view of that particular fact, the order to deposit the amount has now become otiose and can no longer be put into effect.

4. The petitioner had directly paid the amount to the defacto complainant who had also, without any protest received the same. In view of that particular fact, the conditions as stipulated in the order dated 12.09.2023 in Crl.O.P.Nos.20619 and 20620 of 2023, is now modified and the fact that the petitioners have paid directly by bank transfer, a total sum of Rs.20,00,000/- is recorded. The Paragraph No.7, can need not be put into effect, any further, in view of this particular fact of amount being paid directly to the defacto complainant. In view of that particular fact, the time is also extended to execute sureties till 29.12.2023.

5. In view of the fact that the petitioners had exhibited bonafide by making payment directly to the defacto complainant, there need not be any further stipulation that the Petitioners should report before the respondent 2/4

everyday. It is modified and relaxed and the petitioners may appear before the respondent once in a week i.e., every Saturday at 10.30 a.m., for a period of two weeks and thereafter, as and when required for the interrogation.

6. Accordingly, these Criminal Miscellaneous Petitions are ordered.
