This writ petition has been filed as against the order passed by the 1st respondent dated 12.09.2023, thereby strictly fixing the fee for the PG Medical (Clinical and Non clinical) / PG Dental - (Clinical and Para clinical) / MBBS / BDS / B.Sc (Nursing) courses in un-aided Private Self-Financing Medical, Dental & Paramedical Nursing Colleges of Union Territory of Puducherry for the academic year 2023-2024.
2. The learned counsel for the petitioner would submit that the petitioner is a minority self-financing affiliated Institution situated within the Union Territory of Puducherry. Insofar as the fee for the students are concerned, the 2nd respondent Fee Committee headed by its committee members appointed by the 1st respondent from time to time, issued proceedings fixing the
fee that would be collected by the private educational institutions from the students. Accordingly, the 2nd respondent by an order dated 28.10.2021, fixed the fee for the private self-financing medical institutions for MBBS/PG medical courses for the academic year 2021-2022, 2022-2023 and 2023-2024. Accordingly, the petitioner admitted the students and collected fees from the students. While being so, the 1st respondent issued a G.O. MS. No.79 dated 28.10.2022 stating that the fee structure for MBBS/PG medical courses in unaided self-financing private medical colleges functioning in Puducherry for the academic year 2022-2023 shall continue to be the same as was existing prior. Therefore, it was challenged before this Court in W.P No.29302 of 2022 and thereby the petitioner obtained an interim order.
Thereafter, the 1st respondent issued an order dated 18.08.2023 to fix a new fee structure for the MBBS/PG medical courses. Therefore, a contempt petition was filed, since the said order is in violation of the interim order passed by this Court. However, in the contempt petition, the petitioner was given liberty to collect fee as fixed by the 2nd respondent dated 28.10.2022. Thereafter, the 2nd respondent ought to have enhance the fee for the academic year 2024-2025 onwards. However, the 1st respondent passed an order on 12.09.2023 consequent to the proceedings of the 2nd respondent dated 08.09.2023 thereby fixing the fee for the academic year 2023-2024 alone. Hence, this writ petition.

Per contra, the learned Additional Government Pleader, Pondicherry submitted that now the 1st respondent passed an order on 23.08.2024, thereby fixing the fee for the academic year 2024-2025 and 20252026 which is applicable to all unaided Private Self-Financing Medical, Dental and Para Medical Colleges in the Union Territory of Puducherry. This order prevails over the earlier order dated 12.09.2023, which is impugned in the present writ petition.
4. Further, it is also clarified that the petitioner College and other unaided Self-Financing Medical Medical, Dental and Para Medical Colleges in the Union Territory of Puducherry have to collect the fees as per the order dated 23.08.2024 for the academic years 2024-2025 and 2025-2026.
5. Accordingly, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 08.09.2025 Index : Yes/No : Yes/No Speaking/non-speaking order uma
