2. Heard both sides.

3. The learned counsel appearing on behalf of the respondent on instructions submitted that the respondent will have no objection in event the original petition is restored to the file.

4. Considering the averments made in the affidavit filed in support of the application and the submission of the learned counsel for the respondent and also in order to given a fair opportunity to establish his case on merits, this court is inclined to allow this application.

This application is allowed accordingly and the original petition is restored to its file.
