Prayer: Petition is filed under Article 226 of the Constitution of India, seeking Writ of Mandamus, directing the respondents to pay interest for the belated payment of Provident Fund, gratuity, encashment of Earned Leave, Surrender Leave, Commuted Value of Pension at the rate of 12 percent per annum, within specified time. The Writ Petition is filed for the following relief: "directing the respondents to pay interest for the belated payment of Provident Fund, gratuity, encashment of Earned Leave, Surrender Leave, Commuted Value of Pension at the rate of 12 percent per annum, within specified time".
2. The case of the petitioners is that they were appointed as Drivers and Conductors, respectively in the respondent Transport Corporation and retired from service on attaining the age of superannuation. However, there is a delay in settling the terminal benefits to the petitioners and no interest has been paid for the delayed period. Therefore, the petitioners had submitted representations on several dates, requesting to pay interest for the delayed period. Since the same was not considered, the present writ petition has been filed. 3/7
3. The learned Standing Counsel for the respondents would fairly submit that in view of the similar orders passed by this Court in W.P.No.30766 of 2024 dated 23.10.2024, they are willing to pay interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.
4. Heard the learned counsel for both the sides and perused the materials available on record.
5. In view of the submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioners within a period of six weeks from the date of receipt of a copy of this order.
6. The Writ Petition is disposed of with the above lines. No 4/7
costs.
