Prayer: This petition is filed under article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records connected with the proceedings issued in Na.Ka.No.1024/2024/A1 dated 22.10.2024 passed by the second respondent and quash the same and consequently direct the respondents to allow the petitioner to continue at Shop No.3428 and pass orders. 1/5

By consent of learned counsel on either side, this writ petition is taken up for final disposal at the stage of admission itself.

2. This writ petition is filed seeking to issue a Writ of Certiorarified Mandamus calling for the records connected with the proceedings issued in Na.Ka.No.1024/2024/A1 dated 22.10.2024 passed by the second respondent and quash the same and consequently direct the respondents to allow the petitioner to continue at Shop No.3428 and pass orders.

3.Though very many grounds have been raised in this writ petition, the petitioner restricts the prayer only with regard to considering his representation dated 24.10.2024.

4.The case of the petitioner is that the petitioner is working as Sales Man in the Respondent/Corporation and the second respondent vide order dated 28.02.2017 has issued an order transferring the 2/5

petitioner from Shop No.3436 to 3428 as Assistant Sales Man. Now all of sudden the first respondent has issued another transfer, transferring the petitioner from Shop No.3428 to 3879 on 22.10.2024 in Na.Ka.No.1024/2024/A1. Aggrieved over the same the petitioner has come up with this petition.

5. The learned counsel for the petitioner submitted that it would be suffice if a direction is given to the second respondent to consider the representation of the petitioner dated 24.10.2024.

6. The learned standing counsel appearing for the second respondent would submit that the second respondent is ready to consider the grievance of the petitioner in accordance with law.

7. Heard both sides and perused the materials available on record.

8. Considering the facts and circumstances of the case and the limited relief sought for by the petitioner, this Court, without expressing 3/5

any opinion on the merits of the case, directs the second respondent to consider the petitioner's representation dated 24.10.2024 and also look into the allegations made therein and pass orders on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

9. With the aforesaid direction, this writ petition is disposed of. No order as to costs.
