ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.739 of 1998 for an alleged offence under Section 457, 395 & 397 IPC as against six accused persons. The occurrence is said to have taken place on 02.10.1998. All the accused persons broke open the door of the defacto complainant and committed dacoity of gold jewels. The case is pending from the year 2005. The accused no.5 died. Nonbailable warrant is pending as against the remaining accused. The stolen property recovered and handed over to the defacto complainant. Subsequently, the defacto complainant died. There is no previous or subsequent case pending as against the accused persons. Considering the factual matrix, context of the case, it is evident that further continuation of trial proceedings would impinge upon their right to a speedy trial. 3. Accordingly, the proceedings in SC.No.61/2005 on the file of the Court of Chief Judicial Magistrate, Ranipet Taluk, Ranipet, is quashed and this Suo Motu Transfer Case is disposed of.

19.09.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
