PRAYER: Writ Petition filed under Article 226 of the Constitution of India, seeking to issue a Writ of Certiorarified Mandamus to call for the records in respect of the impugned order passed by the respondent vide his office proceedings in Na.Ka.No.52/Chithode/Ka.Ni/E/2022 dated 15.12.2022 rejecting the permission to conduct the cultural dance program on 19.01.2023 at Sri Mariamman Temple Premises existing at Paalakattur, Palayur, Erode District and quash the same and consequently, direct the respondent to give permission and protection for the above said cultural dance program.

O R D E R

The Writ Petition has been filed, seeking to quash the impugned order passed by the respondent vide his office proceedings in Na.Ka.No.52/Chithode/Ka.Ni/E/2022 dated 15.12.2022 rejecting the permission to conduct the cultural dance program on 19.01.2023 at Sri Mariamman Temple Premises existing at Paalakattur, Palayur, Erode District and consequently, direct the respondent to give permission and protection for the above said cultural dance program.

The learned counsel for the petitioner submitted that in order to conduct cultural programme on 19.01.2022 between 06.00 p.m to 11.00 p.m, in the event of "Shri Maariamman Koil Festival" at Paalakattur, Palayur, Erode District, the petitioner has sent a representation, dated 15.12.2022 to the respondents. But, the same has not been considered so far. Hence, the present writ petition has been filed.

3. The learned Government Advocate (Crl.Side), appearing for the respondent submitted that the respondent police has received the 2/5

representation of the petitioner and the same is pending for consideration.

4. I have considered the submission of the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent police.

It is brought to the notice of this Court that the Director General of Police, Tamil Nadu, Chennai, had issued a circular memorandum in Rc.007301/Genl.I(1)/2019, dated 09.04.2019, along with instructions to the Inspectors of Police throughout Tamil Nadu for consideration of applications seeking permission for conducting cultural programme. Therefore, in view of the detailed circular and guidelines issued by the Director General of Police, the respondent police is hereby directed to consider the representation of the petitioner, dated 15.12.2022 and pass suitable orders based on the above said circular. 6. With the above direction, this Writ Petition is disposed of. No costs.
