PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the first respondent to commence and complete the preliminary enquiry as has been directed by the second respondent in his proceedings dated 12.07.2023, submit a report and 1/4

thereafter direct Respondents 1 and 2 to place such report before the Syndicate of Thiruvalluvar University to accord permission to the petitioner to retire from the University Services, as required, within a time limit that may be specified by this Court so as to enable the petitioner to get all this dues, with interest for the delay in disbursement, including the salary fro the reemployment period from 01.02.2020 to 30.04.2020. ORDER

With the consent of both parties, the writ petition was taken up for final disposal at the admission stage itself.

2. The limited prayer sought for in the present writ petition is for a direction to Respondents 1 and 2 to complete the preliminary enquiry within a stipulated time.

3. It is stated by the learned counsel for the petitioner that when he had reached the age of superannuation on 31.01.2020, he was re-employed on 01.02.2020. Thereafter, in view of the decision of the Syndicate, his reemployment was put to an end on 30.04.2020. In the mean time, based on 2/4

certain complaints, the respondents have commenced a preliminary enquiry on 15.06.2023 after the Government had granted permission. Since the enquiry has not been completed till date, the present writ petition has been filed.

This Court is of the view that without going into the merits of the complaint or statements made in the affidavit filed in support of the present writ petition, it would be appropriate to direct the respondents 2 and 3 to complete the enquiry within a stipulated time, so that ends of justice could be secured.

5. Accordingly, there shall be a direction to Respondents 2 and 3 to complete the preliminary enquiry against the petitioner herein as expeditiously as possible in any event, within a period of eight weeks from the date of receipt of a copy of this order.
