The petitioner is an accused in Spl.S.C.No.133 of 2023, now pending before the Principal Special Court for Exclusive Trial of Cases under POCSO Act, Coimbatore, seeks bail. He had been remanded to judicial custody on 13.07.2023.

2.This is the 3rd bail application. The earlier bail application filed by the petitioner had been dismissed on 18.10.2023 in Crl.O.P.No.24101 of 2023 wherein, this Court had observed as follows: " 3.Since the trial has to commence, let me not enter into a detailed discussion of the facts, but after the defacto complainant is examined and cross-examined, the petition can always be filed seeking bail. At this stage, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition stands dismissed."

3. It is stated that still the defacto complainant has not been examined. In view of that particular fact, having no other option, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
