PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for the records of the impugned Refusal slip dated 22.10.2024 in Refusal Slip No.RLF/Thiruporur/58/2024 issued by the 3rd respondent, quash the same and consequently direct the 3rd respondent to register the settlement deed of the petitioner dated 19.10.2024 in respect of her property in Survey No.168/15 (Old S.No.168/13) measuring an extent 1/4

of 4589.5 sq.ft situated at Thandalam Village, Thiruporur Taluk, Chengalpattu District.

ORDER

Challenging the refusal check slip issued by the third respondent against the registration of a settlement deed dated 19.10.2024 presented by her, the petitioner is before this Court.

2. The third respondent refused to register the said document on the ground that no computerized patta was updated in the website.

3. Heard the learned counsel for the petitioner and the learned Special Government Pleader accepting notice for the respondents.

4. The reason given for rejecting the request for registration does not come within the powers given to the third respondent under the Indian Registration Act. The third respondent cannot insist upon the production of revenue documents to register a document. Further, time and again, the Courts have been issuing directions that the Registering Authorities shall confine themselves to the powers given to 2/4

them under the Act and not confer upon themselves the powers not entrusted to them.

5. Hence, the writ petition is allowed, the impugned refusal check slip is quashed and the third respondent is directed to register the settlement deed presented by the petitioner within a period of two weeks from the date of receipt of a copy of this order.
