This Criminal Original Petition is filed to direct the second respondent/Police not to harass the petitioner in the guise of enquiry on the complaint of one Mrs.Varalakshmi, dated 24.09.2024 before All Women Police Station, Puducherry.
2.There is a dispute between the petitioner/husband and his wife. Both have given complaint making serious allegations against each other. Hence the Inspector of Police, Hosur had registered a case in C.S.R.No.365 of 2024 on the complaint given by the petitioner against his wife Varalakshmi and her brother and the said Varalakshmi also filed a complaint before the All Women Police Station, Pondicherry. There is also a divorce petition pending between the parties in the Sub Court, Hosur. While that being so, the said lodged complaints were jointly settled on 29.09.2024 by the Inspector of Police, Hosur, after compromise had reached between both the petitioner and his wife. The petitioner has filed the present petition alleging that the Police is harassing him under the guise of enquiry.
3. According to the petitioner, even though his wife agreed to the 2/5
compromise, she had not withdrawn her complaint pending before the second respondent/Police herein and that the petitioner and his family members were earlier called for enquiry.
4. Per contra, the learned Additional Public Prosecutor (Puducherry) appearing for the respondents, on instructions submitted that as the petitioner had not complied with the terms and conditions of the said compromise, he was called for enqiury by the police and no harassment had taken place.
5. Considering the facts and circumstances of the case and the submissions made by the learned counsel on either side, this Court is not inclined to entertain this petition. Hence, this Criminal Original Petition is dismissed.
