Vakalat to the appellant and hence, the Registry was directed to serve notice to the appellant. Though notice was served on the appellant and the name of the appellant is printed in the cause list today, there is no representation for the appellant either in person or through counsel. It is seen that the appellant is not interested in prosecuting the case. Therefore, this Court has no other option except to dismiss the appeal for nonprosecution. Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs. Consequently, connected miscellaneous petition is closed.
